Welcome to Gingr Informatics Private Limited’s Point of Sale (POS) Android application (“Gingr POS”). By downloading, accessing, or using Gingr POS, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.

Please read the Terms carefully before using Gingr POS. These Terms are governed by Indian law, including the Information Technology Act, 2000, and other relevant Indian laws.

1. Definitions

• App: refers to the Gingr POS Android application.
• User: refers to any person or entity using the App.
• We, Our, or Us: refers to Gingr Informatics Private Limited.
• You: refers to the user of the App.

2. Eligibility

By using the App, you represent that you are legally capable of entering into a binding agreement as per Indian laws, and you are at least 18 years old or using the app under the supervision of a guardian.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use Gingr POS solely for your business's point-of-sale transactions. You may not use the App for any unlawful or unauthorized purposes.

4. Account Registration

To use certain features of the App, you must register and create an account. You agree to provide accurate, current, and complete information, keep your account details secure and confidential, and be responsible for all activities that occur under your account.

5. User Responsibilities

• Use the App for lawful purposes only.
• Do not upload or distribute viruses or malicious code.
• Do not interfere with the App’s security features or violate Indian laws, including the Information Technology Act, 2000.

6. Data Protection and Privacy

Your privacy is important to us. By using the App, you consent to the collection, use, and storage of your personal information in accordance with our Privacy Policy. We comply with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

7. Payment and Billing

All financial transactions processed through Gingr POS must comply with applicable laws, including the Payment and Settlement Systems Act, 2007. You are responsible for ensuring that all transactions are lawful and properly recorded.

8. Intellectual Property

All content, software, and materials within Gingr POS are the property of Gingr Informatics Private Limited or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute the App’s content without prior written permission.

9. Termination

We reserve the right to terminate or suspend your access to Gingr POS at our discretion, without notice, for any reason, including a breach of these Terms. Upon termination, you must cease all use of the App.

10. Limitation of Liability

To the fullest extent permitted by law, Gingr Informatics Private Limited shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Gingr Informatics Private Limited, its employees, and affiliates from any claims, damages, liabilities, and expenses arising out of your use of the App or any breach of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms within the App.

13. Dispute Resolution

In the event of a dispute, the parties agree to submit to the exclusive jurisdiction of the courts located in Chennai, India.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.
